    Regulation of Investment Advisers - The Ongoing Debate

    September 19, 2012, New York City

    In the wake of Dodd-Frank Act and the 2011 SEC study of investment adviser examinations, there have emerged a number of legislative and regulatory proposals that could dramatically change the relationship between investment advisory firms and their regulators. Depending on the size and nature of their business, advisors could even have a new regulatory examiner: the SEC, a state securities department, or possibly an SRO “to be named later.”

    The reasons for these initiatives are varied, including the perceived need to increase the frequency and quality of examinations, the SEC's budgetary constraints, the growth of the industry and the increased complexity of its business.

    What would work best for the industry and for its clients? What is the likely outcome? This discussion will focus on bringing some clarity to these questions as well as identifying what the impact of these changes on the investment management community could look like.

    From West Side Highway:

    Take West Side Highway to Battery Park. Make left on Battery Pl., continue until the street turns into State St., then continue for approximately 2 traffic lights and make a left on Hanover Square.

    From FDR:

    FDR South to Exit 1 (Battery Park, Staten Island Ferry), make right on Broad St. Make right at first traffic light on Water St., go 2 traffic lights to Hanover Square and make a left.

    From Brooklyn Battery Tunnel:

    When exiting tunnel, stay to the left of the traffic light and turn left at the light. When making the left turn, stay right (do not go into underpass), continue on to Battery Place.
